LEWISBURG, W.Va. - A Greenbrier County man hoping to collect damages for being served a burger allegedly topped with filth, lost his lawsuit.



The verdict came at the end of a three-day civil trial in Greenbrier County Circuit Court.



Jim King testified that he purchased two Whoppers from the Burger King franchise at Fairlea on June 21, 2000 and took them to the lunchroom at a nearby furniture store where his wife worked.



"I took a bite out of it," King said to the jury. "It tasted funny. I started to get sick, and I ran to the bathroom and threw up."



King then returned to the lunchroom.



"I took the top bun off it. I saw something brown mixed in with the fixings of the burger. It smelled real bad," King said. "It looked like something ... how can I phrase this? ... like you're going to use the bathroom."



Looking for scientific confirmation, he took the hamburger to the Greenbrier County Health Department for tests. Laboratory analyst Ron Ramirez testified the burger had a high fecal coliform content.



King's attorney, Richard Ford Jr., told the jury that one of the restaurant's employees must have placed feces in King's food.



But several restaurant employees said that they knew nothing about the alleged contamination. One manager testified that such behavior leads to dismissal at the company.



"It could not have happened at this facility," said John MacCorkle, attorney for Burger-King and franchisee ERW Inc. He suggested someone at the furniture store may have tampered with the toppings.



After an hour-long deliberation, the jury ruled Thursday that Burger King could not be held liable.



The same Fairlea restaurant was sued once before over alleged food contamination. In October 2001, a Fayette County woman sued the company after allegedly contracting salmonella from a chicken sandwich. That lawsuit is still pending.
